Recent electricity, water and gas bills to show active connections.
Community Fee Receipts
Proof that community charges are up to date (urbanisation/apartment).
Mortgage Information
Outstanding balance and lender details if the property has a mortgage.
Habitation Certificate

Tax obligations vary depending on your residency status, the sale price, and how long you've owned the property. We always recommend taking independent tax advice before completing a sale.
Capital Gains Tax (CGT)
CGT- Tax on the profit made between your purchase price and sale price.
- Spanish residents: progressive rates of 19%–28% depending on gain.
- Non-residents: flat rate of 19% (EU/EEA) or 24% (outside EEA).
- Various allowances may reduce your liability — speak to a tax adviser.
PlusvalÃa Municipal
Local Tax- Local council tax based on the increase in land value over your ownership period.
- Calculated by the town hall (ayuntamiento) — amount varies by municipality.
- Paid by the seller at completion.
- Recent reforms allow you to challenge if no gain was made on the land.
3% Retention (Non-Residents)
Non-Residents- The buyer is legally required to retain 3% of the sale price.
- This is paid directly to the Spanish Tax Office (Agencia Tributaria).
- Acts as a deposit against your potential capital gains liability.
- If your actual CGT is less, you can reclaim the difference — your lawyer handles this.
Mortgage Cancellation Fees
If Applicable- Early repayment charges from your lender (if any).
- Notary fees for cancelling the mortgage at the land registry.
- Bank administration costs for issuing the cancellation certificate.
